Prosecutor general to remain in office by virtue of law - prosecutor's advisor

Egypt's prosecutor general Talaat Ibrahim shall remain in his position by virtue of the constitution, said his advisor on Wednesday.

Advisor Hassan Yassin's announcement came in response to an appeals court decision to reinstate former prosecutor general Abdel Maguid Mahmoud to his position.

The court ordered earlier today that the justice minister takes the necessary actions to reinstate Mahmoud promptly.

The order annulled a presidential decree that had assigned Talaat Ibrahim to Mahmoud’s position.

President Mohamed Mursi had sacked Mahmoud through a decree that was met with protests and outrage from the opposition.

In his comments on the verdict, Mahmoud told Aswat Masriya that the court decision can be appealed again to a higher court.

A judicial source has confirmed that the court's order is binding, but it can be appealed at the Cassation Court.

The source added to Aswat Masriya that the president and the justice minister are the only ones who hold the legal capacity to challenge the court's decision.

The ruling is based on a complaint filed by Mahmoud to annul the president's decision to sack him.
