CAIRO, Oct 28 (Aswat Masriya) – An Egyptian court will consider on January 13 the challenge against a judicial order sending toppled President Hosni Mubarak and his two sons to prison on embezzlement charges.

In May, a Cairo court sentenced Mubarak to three years in prison for seizing over 125 million Egyptian pounds allocated to presidential palaces. His two sons, Alaa and Gamal Mubarak, were sentenced to four years in prison for aiding their father in embezzling the sum of money.

The former president is serving time in a military hospital in Cairo.

Mubarak's lawyer, Farid El-Deeb filed the challenge last July, calling for the sentence to be overturned, reported state-run news agency MENA.

The former president is being tried alongside his interior minister and six of his aides on charges of killing protesters during the 18-day January 2011 uprising which toppled his regime.

The Cairo Criminal Court postponed the trial to November 29, despite a scheduled verdict on September 27.

Mubarak and his interior minister were sentenced to life in prison in 2012 for the same charges before an appeals court ordered their retrial. The retrial began in April, 2013.
